I actually doubt he had anything to do with it. But lets pretend that he was behind what happened.. why would something that can't be proved at all be a factor in court? I doubt the dude is exactly best buddies with birdman so its a bit too far fetched IMO.

Since nothing can be proved, legally the judge shouldn't involve the thing at all in his decision. Basically Wayne's camp would have to make a case for it, accusing birdman for hiring a hit on Wayne or if the dude that shot snitches on stunna.
