well in the comics its a theory that batman actually kills the joker there finally, because in the comics (and show) you can hear joker laughing, and at one point it stops, leaving only batman laughing, and the pool of water that they show at the end slowly turns a light shade of red

Moore has said he intended it for the joker to be killed but since he made it so ambigous he also left it to the fans if batman crossed the line or not. I personally don't see batman killing joker as he wanted to show the joker and gordon that the system works and that joker and batman have such deep ties that they can't kill one another.
