Is it tacky to use a tagged pic for a background???

I wanna use a pic for a twitter background, but the shit is tagged........and I dont wanna chop that part off b/c it'll look weird and I have a pet peeve about chopped off body parts. LOL dont ask....

But its this pic:



And I think that site took the pics themselves so I dont think that they got it from somewhere THEN tagged it..... but maybeeee if someone's seen it untagged can I have it? Unlesssssss maybe someone can put new text over it for me.
